Terms of Service

1. About These Terms

These Terms of Service (“Terms”) govern your access to and use of the Motors365 website at motors365.co.uk and all related services (the “Service”), operated by Interlink Digital Group Limited (Company No. 05431902, VAT GB132978001), trading as Motors365, a company registered in England and Wales (“we”, “us”, “our”).

By accessing or using the Service you agree to be bound by these Terms. If you do not agree, you must not use the Service. We recommend that you print or save a copy of these Terms for your records.

These Terms were last updated on the date shown above. We may revise them from time to time and will notify you of material changes by email or by a prominent notice on the Service. Your continued use after such notice constitutes acceptance of the updated Terms.

2. Definitions

  • “Account” means a registered user account on the Service.
  • “Consumer” means an individual acting for purposes wholly or mainly outside that individual’s trade, business, craft, or profession.
  • “Content” means all text, data, reports, graphics, images, and other material made available through the Service.
  • “Report” means any vehicle analysis, valuation, MOT history summary, or other output generated by the Service.
  • “Subscription” means a recurring paid plan that grants access to premium features of the Service.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract under the laws of England and Wales. By creating an Account, you represent and warrant that you meet these requirements.

4. Account Registration and Security

To access certain features you must create an Account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Keep your login credentials confidential and not share them with any third party.
  • Notify us immediately at support@motors365.co.uk if you suspect any unauthorised access to your Account.
  • Accept responsibility for all activities that occur under your Account.

We reserve the right to suspend or terminate any Account that we reasonably believe has been compromised or is being used in breach of these Terms.

5. The Service

Motors365 provides AI-powered vehicle intelligence for used car buyers and motor trade professionals. The Service includes:

  • Vehicle analysis reports drawing on MOT history data from the Driver and Vehicle Standards Agency (DVSA).
  • Model-level intelligence, common fault identification, and reliability insights.
  • Market-based valuation estimates.
  • Dealer appraisal and stock management tools (where applicable to your plan).

We may update, modify, or discontinue any part of the Service at any time. Where a change materially reduces the functionality of a paid feature during your current billing period, we will offer a pro-rata refund or credit at our discretion.

6. Subscriptions, Payments, and Refunds

6.1 Free and Paid Plans

Certain features are available free of charge. Premium features require a paid Subscription. Details of plans and pricing are set out on our Pricing page.

6.2 Billing

Subscriptions are billed in advance on a recurring monthly or annual basis (depending on the plan selected). All prices are stated in pounds sterling (GBP) and are inclusive of VAT where applicable. Payment is processed securely by our third-party payment provider, Stripe. We do not store your full card details on our servers.

6.3 Automatic Renewal

Your Subscription will renew automatically at the end of each billing period unless you cancel before the renewal date. You may cancel at any time through your Account settings.

6.4 Refunds

We offer a 7-day money-back guarantee from the date of your first Subscription payment. If you are not satisfied, contact us within 7 days at support@motors365.co.uk and we will issue a full refund. After the 7-day period, payments are non-refundable except where required by law.

6.5 Consumer Cancellation Rights

If you are a Consumer, you have the right to cancel your Subscription within 14 days of purchase under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you have used the Service during this period you may be charged a proportionate amount for the service received. To exercise this right, contact us at support@motors365.co.uk.

6.6 Price Changes

We may change our prices from time to time. We will give you at least 30 days’ written notice before any price increase takes effect on your Subscription. If you do not agree to the new price, you may cancel before the increase applies.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorised access to any part of the Service, other users’ accounts, or our systems.
  • Use automated scripts, bots, scrapers, or similar tools to access or extract data from the Service without our prior written consent.
  • Reproduce, redistribute, sell, or sublicense Reports or Content to third parties except as expressly permitted by your plan.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Upload or transmit viruses, malware, or other harmful code.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

We reserve the right to suspend or terminate your access immediately if you breach this section.

8. Intellectual Property

All intellectual property rights in the Service, including but not limited to the software, design, text, graphics, logos, and Reports, are owned by or licensed to Interlink Digital Group Limited (trading as Motors365). Nothing in these Terms transfers any intellectual property rights to you.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service and Reports for your own personal or internal business purposes in accordance with your plan. You may not copy, modify, distribute, sell, or lease any part of the Service or its Content without our express written permission.

9. Data Sources and Third-Party Services

Reports may incorporate data from third-party sources including but not limited to the DVSA, DVLA, and publicly available market data. We do not control these sources and make no guarantee as to the accuracy, completeness, or timeliness of third-party data. Your use of any third-party service linked from our Service is subject to that third party’s own terms and conditions.

10. Disclaimers and Limitations of Liability

10.1 Informational Purposes Only

Reports and Content are provided for general informational purposes only. They do not constitute professional mechanical, financial, or legal advice. You should always arrange an independent professional vehicle inspection before making a purchase decision.

10.2 No Guarantees

While we use reasonable endeavours to ensure accuracy, the Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.3 Limitation of Liability

To the maximum extent permitted by the laws of England and Wales:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunity, or goodwill.
  • Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the total amount you have paid to us in the 12 months immediately preceding the claim.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

10.4 Consumer Rights

If you are a Consumer, you have legal rights under the Consumer Rights Act 2015 and other consumer protection legislation. Nothing in these Terms is intended to affect those statutory rights. You may obtain advice from your local Citizens Advice Bureau or Trading Standards office.

11. Indemnification

If you are using the Service in a business capacity, you agree to indemnify and hold harmless Interlink Digital Group Limited (trading as Motors365), its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms or your use of the Service. This clause does not apply to Consumers.

12. Suspension and Termination

We may suspend or terminate your Account and access to the Service at any time if:

  • You breach any provision of these Terms.
  • We are required to do so by law or a regulatory authority.
  • We reasonably believe your Account has been compromised.
  • We decide to discontinue the Service (in which case we will give you reasonable notice).

You may terminate your Account at any time by contacting us or through your Account settings. Upon termination, your right to use the Service ceases immediately. We may retain your data in accordance with our Privacy Policy and applicable law.

13. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, pandemic, government action, fire, flood, cyber-attack, telecommunications failure, or third-party service outages.

14. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable. If it cannot be modified, it shall be severed from these Terms without affecting the validity and enforceability of the remaining provisions.

15. Waiver

No failure or delay by us in exercising any right or remedy under these Terms shall operate as a waiver of that right or remedy. A waiver of any right or remedy on one occasion shall not be construed as a waiver of that right or remedy on any subsequent occasion.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Interlink Digital Group Limited (trading as Motors365) in relation to your use of the Service and supersede all prior agreements, representations, and understandings.

17. Third-Party Rights

These Terms are not intended to confer any benefit on, or be enforceable by, any person who is not a party to them. The Contracts (Rights of Third Parties) Act 1999 shall not apply to these Terms.

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a Consumer habitually resident in another part of the United Kingdom, you may also bring proceedings in the courts of your country of residence, and nothing in this clause affects your statutory rights as a Consumer.

19. Complaints and Dispute Resolution

If you have a complaint about the Service, please contact us first at support@motors365.co.uk. We will endeavour to resolve your complaint promptly and fairly.

If we are unable to resolve your complaint to your satisfaction and you are a Consumer, you may be entitled to use an alternative dispute resolution (ADR) service. The European Commission’s Online Dispute Resolution platform is no longer available to UK consumers; however, you may contact your local Trading Standards office or Citizens Advice for guidance.
